1. Acceptance of Terms
Welcome to Party Perfection Canada. By accessing and using our event planning services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and others who access or use our party planning and event organization services.
We reserve the right to update and modify these terms at any time without prior notice. Your continued use of our services following the posting of changes will mean that you accept and agree to the changes. We encourage you to review these terms periodically to stay informed about our policies.
2. Service Description
Party Perfection Canada provides comprehensive event planning and celebration organization services across Canada, including but not limited to birthday parties, corporate events, weddings, anniversaries, and special celebrations. Our services include venue selection, decoration planning, catering coordination, entertainment booking, and complete event management.
We strive to deliver exceptional service quality and memorable experiences for all our clients. However, certain aspects of events may be subject to third-party vendor availability, weather conditions, and other factors beyond our direct control. We will always communicate any potential limitations or changes as soon as they become known.
3. Booking and Payment Terms
All event bookings require a signed service agreement and an initial deposit to secure your date. Payment schedules vary depending on the scope and scale of your event, with final payments typically due 7-14 days before the event date. We accept various payment methods including credit cards, bank transfers, and certified checks.
Cancellation policies apply based on the timing of cancellation requests. Cancellations made more than 30 days in advance may receive a partial refund minus administrative fees. Cancellations made less than 30 days before the event may be subject to additional charges for non-refundable deposits made to vendors and suppliers.
4. Client Responsibilities
Clients are responsible for providing accurate information about their event requirements, guest count estimates, special dietary needs, accessibility requirements, and any specific preferences or restrictions. Any changes to event details must be communicated in writing and may be subject to additional charges.
Clients must ensure that all necessary permits, licenses, and approvals are obtained for their events, particularly for outdoor events or those involving alcohol service. Clients are also responsible for the conduct of their guests and any damages that may occur during the event beyond normal wear and tear.
5. Limitation of Liability
While we take every precaution to ensure successful events, Party Perfection Canada's liability is limited to the total amount paid for our services. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, incurred by you or any third party.
We maintain comprehensive liability insurance and work only with licensed and insured vendors. However, we cannot be held responsible for acts of nature, venue closures, vendor failures beyond our control, or other unforeseen circumstances that may affect your event.
6. Privacy and Data Protection
We respect your privacy and are committed to protecting your personal information. All client data is handled in accordance with Canadian privacy laws and our comprehensive Privacy Policy. We use your information solely for the purpose of planning and executing your events and will never share your personal details with third parties without explicit consent.
Photos and videos taken during events may be used for marketing purposes unless specifically requested otherwise in writing. We always obtain appropriate permissions before using any images featuring identifiable individuals in our promotional materials.
7. Intellectual Property
All creative designs, concepts, proposals, and materials developed by Party Perfection Canada remain our intellectual property until full payment is received. Clients receive unlimited use rights for their specific event but cannot reproduce or share our designs for commercial purposes.
We respect the intellectual property rights of others and expect the same consideration. Any custom themes, logos, or branded materials provided by clients remain their property, and we use them solely for the purpose of their contracted events.
8. Force Majeure
Neither party shall be liable for any failure or delay in performance due to events beyond their reasonable control, including but not limited to acts of God, natural disasters, government actions, epidemics, terrorism, or other unforeseen circumstances that make event execution impossible or impractical.
In such cases, we will work with clients to reschedule events when possible or provide alternative solutions. Any deposits or payments made may be applied to future services or refunded according to the specific circumstances and vendor policies.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Canada and the specific provincial laws where services are rendered. Any disputes arising from these terms or our services will be resolved through binding arbitration or in the courts of the appropriate provincial jurisdiction.
We encourage open communication to resolve any concerns or disputes amicably. Our client service team is always available to address questions or issues that may arise during the planning process or after events.
